Transport packaging is not subject to system participation. However, there are special take-back and recycling obligations that every distributor should be aware of.

What is transport packaging?

Transport packaging is crucial for the transportation of goods between distributors, such as  between manufacturers and wholesalers or retailers. According to § 3 of the German Packaging Act (VerpackG), they facilitate the transportation of products and protect them from damage during the transportation process. At the same time, the process should be as cost-efficient and easy to handle as possible. Transport packaging remains in the business-to-business sector (B2B sector) and, unlike sales packaging, is not passed on to end consumers. What is legally required?

The obligations for distributors of transport packaging have been significantly extended by the German Packaging Act (VerpackG). This article will help you to clarify to what extent the VerpackG applies to your business and what you need to bear in mind.

 

According to the packaging register, transport packaging is not subject to system participation. Nevertheless, from July 1, 2022, those placing transport packaging on the German market must register the type of packaging in the LUCID packaging register. In addition, they must dispose of the packaging properly and return it to the recycling cycle. This is called exempting from obligations instead of licensing. These special take-back and recycling obligations are regulated in the Packaging Act (VerpackG).

 

Manufacturer or distributors are obliged to take back transport packaging from their customers after use, free of charge. The obligation to take back can also be delegated to a third party. Distributors must provide evidence of compliance with the take-back and recycling requirements (obligation to provide evidence). The take-back obligation is precisely defined in Section 15 of the Packaging Act.

 

In addition, some transport packaging reaches the end consumer. At that point, it is considered as shipping packaging. This also obliges the distributor to participate in the system if the packaging typically ends up as waste in private households or at similar sources.
